This Privacy Policy describes the types of information The Chamberlain Group, Inc. and its wholly and majority-owned entities (“CGI”) collects from and about you when you visit www.chamberlain.com, www.liftmaster.com, www.chamberlaingroup.com, www.myq.com, https://dealer.liftmaster.com or any other of our websites where this policy is posted (each a “Site”), use our mobile applications (each an “App”), including, without limitation, myQ®, Tend Insights, IPAC, CapXL, LiftMaster Cloud Services, HomeBridge or otherwise interact with us or request services from us as described further in this Privacy Policy. The Sites, Apps, and other interactions are collectively the “Services.” This Privacy Policy also explains how CGI and its affiliated entities may use and disclose such information, as well as your ability to control certain uses of your personal information.

By using any of our Services, you agree to the collection, use, and disclosure of your personal information as described in this Privacy Policy. If you do not, please do not use the Services.

INFORMATION COLLECTION

Information You Provide

We collect information from you when you choose to share it with us. This may include when you use our Services, search for a retailer or dealer, create an online account with us, register a product with us, provide information to one of our sales coordinators, speak with one of our representatives by phone, sign up for newsletters or our email list, participate in a survey or promotion, request information from us, or otherwise contact us.

The information we collect from you may include, but is not limited to:

  • Personal identifiers, such as name, address, email address, telephone, or mobile number;
  • Protected classification information, such as age, sex, gender, nationality, date of birth, or marital status;
  • Commercial information, such as credit or debit card number or other financial information
  • Biometric information, such as facial recognition;
  • Video images and audio of you and those that come within range of your cameras;
  • Internet usage information, such as browsing time, cookie information, Internet Protocol (“IP”) address, or website history;

  • User account information, such as CGI account number;
  • Geolocation of any computer, mobile device, or other electronic device used to access a Site or App;
  • Information regarding the products or equipment purchased;
  • Information regarding your usage of, and performance of, our products, equipment and Apps; and
  • Charges you incur and other information relating to your transactions.

Information Collected from Third Parties or Other Sources

We may obtain personal or other information about you from third parties or other sources, and combine this information with the information we collect from and about you through the Services. Such information may include, but is not limited to:

  • Information, including geolocation information, collected through one of our mobile applications;
  • Information obtained through communications that you make through a third party, such as through our network of independent retailers and/or dealers;
  • Information obtained through transactions you complete with us or our retailers, including charges you incur;
  • Information about your credit history or other publicly available information about you from consumer reporting agencies; and
  • Any other information obtained through companies that have business relationships with us, such as our licensees, affiliates, and business partners.

We may also obtain information about you from other online sources, including when you connect with CGI through its official corporate pages on third party social networks (such as Facebook) or the “apps” on those pages. This information may include, but is not limited to, name, user name, demographic information, updated address or contact information, interests, and publicly-observed data, such as from social media and online activity. We may combine this information with the information we collect from and about you through the Services.

Information Automatically Collected

We may use cookies, web beacons, pixel tags, JavaScript, or other technologies to collect certain information about visitors to any of our Sites or Apps and interactions with our emails and online or mobile advertisements, and may use such information to allow CGI to keep track of analytics and certain statistical information that enables us to improve our Sites and Apps and provide you with more relevant content and advertising on our Sites, Apps, or other websites or mobile applications.

For example, we may automatically collect certain information from you, including but not limited to your browser type, device type, operating system, software version, IP address, geolocation, phone model, phone operating system, and the domain name from which you accessed the Services. We also may collect information about your use of a Site or App, including the date and time you visit the Site or App, the areas or pages of the Site or App that you visit, the amount of time you spend viewing or using the Site or App, the number of times you return to the Site or App, other click-stream or site usage data, emails that you open, forward or click-through to our Site or App, and other sites that you may visit.

We may also use third party cookies and other technologies to support our Services, provide services on our behalf, facilitate business transactions on our behalf, or provide relevant advertising to you. Some of these third parties may use technology such as cookies, web beacons, pixel tags, log files, or Flash cookies on our Sites or Apps, which may send some of the above-referenced information to those third parties.

Tracking Options and California Do Not Track Disclosures

Certain parts of our Sites and Apps require cookies. You are free to set your browser or operating system settings to limit certain tracking or to decline cookies, but by doing so you may not be able to use certain features on the applicable Site or App, or take full advantage of all of our offerings. Our system may not respond to Do Not Track requests or headers from some or all browsers. This Privacy Policy does not cover the collection methods or use of the information collected by Third-Party Ad-Servers, and CGI is not responsible for cookies or other tracking technology in third-party ads. Combination of Information

We may combine the information we receive from and about you, including information you provide to us and information we automatically collect through our Sites and Apps, as well as information collected from other online sources or from third party sources to help us tailor our communications to you and to improve our Services.

INFORMATION USE

CGI may use the information we collect from and about you for any of the following purposes:

  • To validate, confirm, verify, and track your account, products or services (including to process payment card transactions, or to contact you about your account, products or services);
  • To enhance your online experience, including as a way to recognize you and welcome you to a Site or App, make the account usage and purchasing process faster and smoother and provide you with customized Site or App content, targeted offers, and advertising on Sites, Apps (including geo-targeted advertising), or via email, telephone, text message, or by mail;
  • To recognize your online activities over time and across different websites and devices;
  • To contact you with information, newsletters, promotional materials and contests from CGI or on behalf of our business partners, licensees, and affiliates;
  • We may also share user information with our co-sponsors, business partners and service providers to offer products or services which we believe may be valuable or useful to our visitors. They may use a pixel tag or other similar technology to collect anonymous information about your visits to Sites, and they may use that information to target advertisements for our products and Services.

  • To review the usage and operations of our Sites or Apps, and improve our content, products, and services;

Additionally, if you use any of the Sites or Apps to connect with third party services you authorize us to use information from and about you, on your behalf, to interact with these third party services based on your requests.

INFORMATION SHARING

CGI may disclose the personal information we collect from and about you in the following ways:

  • With our affiliated companies, retailers and dealers, including subsidiaries of such companies;
  • With our third party service providers that provide business, professional or technical support functions for us;
  • With our agents, licensees, and other companies that assist us in providing a product or service to you, including, but not limited to, making your purchase and installation; providing you with customer assistance; processing and/or confirming your transactions; providing you with the services you requested; assessing creditworthiness; billing and collecting any amounts owed in connection with your account or products or services purchased; or recovering any monies due, such as through debt collection agencies;
  • With our select licensees, affiliates, retailers and business partners that we believe may have offers of interest to you, including for their own marketing purposes;
  • As necessary if we believe that there has been a violation of our Terms of Use or of our rights or the rights of any third party;
  • To respond to judicial process or provide information to law enforcement or regulatory agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; and

CGI may also share aggregate or anonymous non-personal information with third parties for their marketing or analytics uses.

Also, CGI may sell or purchase assets during the normal course of our business. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should such a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use personal information provided through the Services in a manner that is consistent with this Privacy Policy.

YOUR CALIFORNIA PRIVACY RIGHTS

If you are a California resident, the California Consumer Privacy Act (“CCPA”) (Civil Code Section 1798.100, et seq.) may provide Consumers with specific rights regarding your personal information. These may include:

  • Information about Collection, Sale or Disclosure: You have the right to be informed of the categories of personal information that we collect about you, the categories of sources from which the personal information was collected, the business or commercial purposes for which the personal information is used, disclosed, or sold, and the categories of third parties with whom we share the personal information, as set forth in this Privacy Policy.
  • Access to Specific Information: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve months. Once we have verified your identity, we will disclose the specific pieces of personal information we collected about you, which will be made in writing and delivered through your account with us, if you maintain such an account. If you do not maintain an account with CGI, we will provide such information electronically, at your option, in a readily useable format that allows you to transmit the information from one entity to another entity without hindrance.
  • Deletion Request Rights: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.
  • Personal Information Sales Opt-Out Rights: You have the right to opt out of the sale of your personal information.

To exercise the rights described above, it may be necessary for us to verify your identity or authority to make the request and confirm the personal information relates to you. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You also may make a verifiable consumer request on behalf of your minor child.

  • Non-Discrimination: Unless permitted by applicable law, we will not discriminate against you for exercising any of your privacy rights under CCPA or applicable law, including by denying you goods or services; charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; providing you a different level of quality of goods or services; or suggesting that you will receive a different price or rate for goods or services or a different level of quality of goods or services.

CGI will confirm receipt of the request within 10 days and explain how it will process the request. CGI will then respond to the request within 45 days. CGI may require an additional 45 days (for a total of 90 days) to process your request, but in those situations CGI will provide you a response and explanation for the reason it will take more than 45 days to respond to the request.

Non-affiliated third parties are independent from CGI and if you wish to receive information about your disclosure choices or stop communications from such third parties, you will need to contact those non-affiliated third parties directly.

LINKS TO OTHER WEBSITES

The Sites, Apps, and email messages from us may contain links to third-party websites, which may have privacy policies that differ from our own. You should be aware that the collection, retention and use of any data you provide on these websites will be governed by the privacy policy of the company providing the website and not by this policy. We are not responsible for the practices of such websites.

PUBLIC FORUMS

Any information you may disclose on our Sites or Apps, in blogs, on message boards, in chat rooms, or on other public areas on a Site, App, or other third-party website that the Site or App may link to, becomes public information. Please exercise caution when disclosing personal information in these public areas. We reserve the right to remove any posting or content in a posting at our sole discretion.

CHILDREN’S PRIVACY

Protecting children’s privacy is important to us. We do not direct our Sites or Apps to, nor do we knowingly collect any personal information from, children under the age of thirteen. If we learn that a child under the age of thirteen has provided personally identifiable information to a Site or App, we will use reasonable efforts to remove such information from the files of such Site or App.

DATA SECURITY

We have taken certain physical, administrative, and technical steps to safeguard the information we collect from and about our customers and Site and App visitors. While we make every reasonable effort to help ensure the integrity and security of our network and systems, we cannot guarantee our security measures. When you enter sensitive information (such as credit card information) on our forms, we encrypt the transmission of that information using secure socket layer technology (SSL).

1. WHAT IS TEND AND WHAT PRODUCTS DOES IT OFFER?

Tend offers the communication software Tend IM, MobileWatch, iSecurity+ and other applications, which may be added, extended or changed from time to time.

2. WHAT INFORMATION DOES TEND COLLECT?

Tend may gather and process information about you, including (but not limited to) information in the following categories:

(a) Identification data (name, address, telephone, email address etc.);

(b) Profile information (e.g. age, sex, country of residence etc.)

(c) Electronic identification data (addresses IP, cookies, etc.);

(d) Banking and payment information (credit card information, account number, etc.);

(e) Survey result and usage information;

(f) Products or services ordered and delivered;

(g) Video and sound data which are passed through Tend server. (This does not include the Video/Audio data in p2p session. Please refer to Article 6 for more details)

(h) List of your contacts;

Traffic data (data processed for the purpose of the conveyance of communications or the billing thereof, including, but not limited to, the duration of the IM and Video Session, access history, etc.).

3. HOW DOES TEND USE THIS INFORMATION AND FOR WHAT PURPOSE?

Our primary purpose in collecting information is to provide you with a safe, smooth, efficient, and customized experience. Tend collects and processes, or has third party service providers acting on Tend’s behalf collecting and processing, personal data relating to you, as permitted or necessary to:

  • provide communication products, in particular to convey the communications you make by means of the Tend software and/or the Tend products;
  • take, process or deliver orders made via our websites, invoice you or notify you of the status of your order;
  • provide other services for you (as described when we collect the information);
  • register products that you have purchased with the manufacturer or service provider for warranty or technical support;
  • provide you with customer support and troubleshoot problems;
  • compare information for accuracy;
  • inform you about service updates and faults;
  • request feedback or participation in on-line surveys;
  • resolve disputes;
  • verify your identity;
  • customize, measure, and improve Tend software, our products and websites content and layout;
  • create an eCommerce ecosystem combining the Tend group entities' services;
  • provide and invoice certain joint services with other Tend group entities;
  • organize and carry out Tend's and/or Tend group's marketing or promotional operations/offers, contests, games and similar events; and
  • protect your, Tend's and Tend group entities' interests, including in particular to enforce our Terms of Service and fight against fraud, (together, the Purposes).

4. TO WHOM DOES Tend TRANSFER YOUR PERSONAL INFORMATION?

Except as provided below, Tend shall not sell, rent, trade or otherwise transfer any personal and/or traffic data or communications content to any third party without your explicit permission, unless it is obliged to do so under applicable laws or by order of the competent authorities.

Tend may share your information with Tend group entities for certain purposes, and in particular insofar as necessary to (1) create an eCommerce ecosystem combining the Tend group entities’ services; (2) provide and invoice certain joint services; (3) organize marketing or promotional operations, contests, games and similar events; and (4) fight against fraud.

In order to provide you with Tend products you have requested, Tend may sometimes, if necessary, share your personal and traffic data with carriers, partner service providers and/or agents, for example the mobile service gateway provider, distributor of Tend software and/or Tend products and/or the third party banking organization or other providers of payment services. Tend will always require these third parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant legislation.

Please be informed that, notwithstanding the abovementioned, in the event of a designated authority lawfully requesting Tend or Tend’s local partner to retain and provide personal data, communications content and/or traffic data, Tend and/or its local partner will provide all reasonable assistance and information to fulfill this request.

Your information may be stored and processed in any country in which Tend and the Tend group maintain facilities. In this regard, or for purposes of sharing or disclosing data in accordance with this article 4, Tend reserves the right to transfer information outside of your country. By using Tend software, Tend’s websites or Tend products you consent to any such transfer of information outside of your country. As Tend continues to develop its business, Tend might sell or buy subsidiaries or business units. In such transactions as well as in the event Tend or substantially all of its assets are acquired by a third party, personal information of Tend users will generally be one of the transferred business assets. We reserve the right to include your personal information, collected as an asset, in any such transfer to a third party.

5. WHAT ARE COOKIES AND HOW DOES TEND USE THEM?

Cookies are pieces of information that the Tend software may store on your computer’s hard drive in order to help web applications to recognize you or your preferences. Tend’s cookies may contain identifying information. Cookies enable Tend to gain information about the use of its websites. This information may be analyzed by third parties on our behalf. This information may be aggregated and used to provide more useful products to our customers by helping us understand which parts of the software, our website, and our mobile apps are used, and how they are used. We may also display this aggregated information publicly or provide it to others; however, we do not disclose personally-identifying information.

The Help option on the toolbar of most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Please bear in mind that some personalized services may not be available if you choose to disable cookies.

Third Party Cookies

The adverts appearing on our websites are delivered to you by our web advertising partners. Please be aware that these third parties may use cookies to obtain information about your visits to this site, such as number of times you have viewed an advert (but not your name, address, or other personal information). This information is used to serve adverts to you.

6. INFORMATION OUTSIDE TEND'S CONTROL

Video/Audio data in a p2p session

If your video/audio session is in p2p mode (as indicated on the top of the Video Window), video/audio data will be transmitted directly between the receiver and the sender in encrypted format. Tend server plays the role of facilitating the initial connection between the sender and receiver. Tend server will not collect nor store any video/audio data in p2p mode.

Linked Websites

Tend websites may contain links that will let you leave Tend’s website and access another website. Linked websites are not under the control of Tend and it is possible that these websites have a different privacy policy. The Privacy Statement applies solely to personal information that is acquired on the Tend websites or through your use of the Tend software, Tend products and/or your relationship with Tend, so Tend urges you to be careful when you enter any personal information online. Tend accepts no responsibility or liability for these other websites.

7. HOW DOES TEND PROTECT YOUR PERSONAL INFORMATION?

Tend and Tend group entities shall take appropriate organizational and technical measures to protect the personal data and traffic data provided to it/them or collected by it/them, and shall not retain it any longer than permitted in order to perform its services or as required under relevant legislation. Your personal and traffic data can only be accessed by authorized employees of Tend or the concerned Tend group entities that need to have access to this data in order to be able to fulfill their given duties.

Tend shall take appropriate technical measures to protect the confidentiality of the communications content via its Tend software and other Tend products, with due observance of the applicable obligations and exceptions under the relevant legislation.

Notice To/Regarding Children Under the Age of 13
Tend believes that children using the Internet require special protection, and we urge parents or guardians to explain Internet safety to their children. Parents are urged to spend time online with their children to become familiar with the types of content available on the Tend sites and the Internet in general. Control tools are available from online services and software manufacturers to help create a safer environment for children.

If you are under 18 years of age, you should not provide any personally identifiable information (for example, your last name, home address or e-mail address) on these sites without the knowledge and permission of your parent or guardian. If Tend learns that you are under 18 years of age, Tend will not maintain or use any personally identifiable information about you without the verifiable consent of your parent or guardian, except as allowed by law. This may mean that you will be unable to participate in some activities on the sites without that verifiable consent.

8. PERSONAL DATA OF FRIENDS

You may be interested in inviting your friends to join Tend. In the event you wish to use Tend’s referral service, you will be directed to a webpage and will have the possibility of adding one or more email addresses in an online form. The information entered in this form, will only be used for the purposes of automatically generating an email message to these potential Tend users.

9. CONTACTING YOU

Tend may from time to time ask you to provide information on your experiences which will be used to measure and improve quality. You are at no time under any obligation to provide any of such data. Any and all information which is voluntarily submitted in feedback forms on the website or any survey that you accept to take part in is used for the purposes of reviewing this feedback and improving the Tend software, Tend and Tend group entities’ products and websites. Tend also collects information about your usage of the Tend software, the websites and Tend and Tend group entities’ products. Tend reserves the right to utilize this information for marketing purposes, for instance by displaying selected comments on the website or in other communications. Tend may share anonymous and aggregated information with third parties, for example to serve targeted advertising.

Tend may contact you to send you messages about faults and service issues. Further, Tend reserves the right to use email or the Tend software to notify you of any eventual claims related to your use of Tend software, the Tend websites and/or Tend products, including without limitation claims of violation of third party rights.

Tend may also use email or the Tend software to keep you up to date with news about the Tend software and Tend products that you have purchased and/or to inform you about other Tend or Tend group entities’ products unless you have opted out of receiving this information. You can instruct us whether or not you wish to be contacted for these purposes by checking or unchecking the box indicating your preferences, as applicable, at the place where your personal information is collected. In addition, with each communication you receive from Tend, you will be given the opportunity to indicate if you do not wish to receive future communications from the company. 10. CAN THIS PRIVACY STATEMENT BE MODIFIED?

Tend reserves the right to modify the provisions of this Privacy Statement if deemed necessary. We will inform you of these changes by publishing the revised Privacy Statement at www.isecurityplus.com/privacy. The revised Privacy Statement shall become effective within thirty (30) days of such publishing, unless you expressly accept the revised statement earlier by clicking on the accept button. You agree that the express acceptance by you, or your continued use of the Tend software or Tend products after the notice period of thirty (30) days, shall constitute your acceptance of the Privacy Statement.

12. HOW LONG IS YOUR PERSONAL DATA KEPT BY Tend?

Tend and, where relevant, the Tend group entities will retain your information for as long as is necessary to: (1) fulfill any of the Purposes (as defined in article 3 of this Privacy Statement) or (2) comply with applicable legislation, regulatory requests and relevant orders from competent courts.

13. BIOMETRIC INFORMATION?

Biometric Data Defined
As used in this policy, Biometric Data includes biometric identifiers including the face geometry recognition and capture as used in Tend’s camera and software products, and biometric information including the information relating to such face recognition and capture as converted, stored, and used in Tend’s products and software to identify an individual.

Purpose for Collection of Biometric Data
Tend collects, stores, and uses your Biometric Data solely for the proper functioning of Tend’s video camera monitoring products, as described in Tend’s websites and other descriptive materials.

Your Notification
To the extent that Tend collects, captures, or otherwise obtains your Biometric Data, Tend, through this policy, is hereby Informing you in writing that Tend is collecting, capturing, or otherwise obtaining your Biometric Data for purposes of the functionality of the products, and has informed you of the specific purposes and length of time for which your Biometric Data is being collected, stored, and used.

To the extent that Tend collects, captures, or otherwise obtains Biometric Data relating to a person other than you who is observed by a camera, such person, as far as in known by Tend, does not have a relationship with Tend, and the identity of such person is not available to Tend such that the person could be contacted by Tend in relation to the subject matter of this policy.

Disclosure
Tend will not sell, lease, trade, or otherwise profit from your Biometric Data. Tend will not disclose or disseminate any Biometric Data to anyone other than its authorized vendors without/unless: a. First obtaining your written consent to such disclosure or dissemination; b. The disclosed data completes a financial transaction requested or authorized by you; c. Disclosure is required by state or federal law or municipal ordinance; or d. Disclosure is required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.

Retention Schedule
Tend shall retain your Biometric Data only until, and shall permanently destroy such data when, the first of the following occurs:
The initial purpose for collecting or obtaining such Biometric Data has been satisfied; or within 12 months of your last interaction with Tend.

Data Storage
Tend shall use a reasonable standard of care to store, transmit and protect from disclosure any electronic Biometric Data collected. Such storage, transmission, and protection from disclosure shall be performed in a manner that is the same as or more protective than the manner in which Tend stores, transmits and protects from disclosure other confidential and sensitive information, including personal information that can be used to uniquely identify an individual or an individual’s account or property, such as account numbers, PINs, driver’s license numbers and social security numbers.
